These Terms and Conditions ("Terms") govern your use of the GEMO mobile application ("the App") operated by Ocotek LLC ("us", "we", or "our").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

  1. Use of the App
    1. The App is intended for personal, non-commercial use only. You may not use the App for any illegal or unauthorized purpose.
    2. You agree to comply with all applicable laws and regulations while using the App.
  2. Collection and Use of Information
    1. By using the App, you consent to the collection and use of information as described in our Privacy Policy.
    2. We may collect and process your device's unique identifier and location information for the purpose of providing our services and improving user experience.
  3. Intellectual Property Rights
    1. The App and its original content, features, and functionality are owned by Ocotek LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
    2. You may not modify, reproduce, distribute, transmit, display, perform, or create derivative works of any part of the App without prior written consent from Ocotek LLC.
  4. Disclaimer
    1. The App is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
    2. We do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the App or otherwise relating to such materials or on any sites linked to the App.
  5. Limitation of Liability
    1. In no event shall Ocotek LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
  6. Governing Law
    1. These Terms shall be governed and construed in accordance with the laws of United States of America, without regard to its conflict of law provisions.
  7. Changes to Terms
    1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
